These Terms and Conditions, together with our Privacy Notice and any other policies posted on our website, set out the rules for using www.hoalani.com and any related sites we operate (the "Site"). By using the Site, you agree to these terms. If you do not agree, please do not use the Site.

Hoalani Group is a global company. We have offices and staff in the United States, Spain, Portugal, Ghana, Canada, Denmark, and Germany. Our headquarters is in Carmel, Indiana, United States. Because we serve clients in many countries, these terms are written to respect the privacy and consumer laws that apply to you in your location.

By visiting the Site, filling out a form, signing up for a newsletter, or asking us to contact you, you agree to these terms. You confirm that you are at least 18 years old or that you have permission from a parent or guardian. You also confirm that you have the right to act for any company you say you represent.

You may view and print pages from the Site for your own business or personal use. You may share links to our blog posts. You may not copy, change, or republish our content in any other way without our written approval.

If you send us comments, ideas, questions, case studies, or feedback through the Site or through email, you give us the right to use that input to improve our work, train our staff, and shape future content. We will not share your name or your company's name without your permission unless the law requires it.

If you sign up for our newsletter, register for an event, or download a resource, we may send you emails about our services, blog posts, events, and special offers. You can opt out at any time by clicking the "unsubscribe" link in any email or by emailing marketing@hoalani.com.

The Site gives general information about Hoalani Group and our work with Microsoft Dynamics 365, Business Central, CRM, the Power Platform, and document management tools. Nothing on the Site is a binding offer, a quote, or professional advice for your business. Any work we do for a client is set out in a separate signed agreement.

We work hard to keep the Site useful and current. Even so, the Site is provided "as is" and "as available." To the fullest extent allowed by law, we do not promise that:

  • The Site will always be available or free of errors.
  • The information on the Site is complete, current, or fit for your specific needs.
  • The Site will be free of viruses or other harmful items.

Where the law gives you rights that cannot be waived, those rights still apply.

12. Limits on Our Liability

To the fullest extent allowed by law, Hoalani Group and our directors, officers, employees, and partners are not liable for any indirect, special, or consequential loss that comes from your use of the Site. This includes loss of profits, loss of business, loss of data, or loss of goodwill. Nothing in these terms limits our liability for fraud, gross negligence, or anything else that cannot be limited by law.

13. Your Promise to Protect Us

You agree to defend and hold harmless Hoalani Group and our staff against any claim, loss, or cost (including reasonable legal fees) that comes from your misuse of the Site, your breach of these terms, or your violation of any law or third party right.

14. Suspension and Changes

We may change, pause, or stop any part of the Site at any time, with or without notice. We may also block access to the Site for any user we believe is breaking these terms or a law. We are not liable to you or anyone else for changes to the Site.

15. Governing Law and Disputes

These terms are governed by the laws of the State of Indiana in the United States, without regard to its rules on conflicts of law. Any dispute will be heard in the state or federal courts located in Hamilton County, Indiana, unless a stronger local consumer law in your country gives you the right to sue in your home courts.

If you are in the European Economic Area or the United Kingdom, you may also use the local consumer dispute services in your country. If you are in Brazil, you may use the local consumer protection bodies. Nothing in this section takes away rights you have under the law where you live.

16. Changes to These Terms

We may update these terms from time to time. When we do, we will post the new version on this page and update the "Effective Date" at the top. If the changes are major, we will give clear notice on the Site. Your continued use of the Site after the change means you accept the new terms.

17. Other Important Points

If any part of these terms is found to be invalid, the rest will still apply. Our failure to enforce a right does not mean we give it up. These terms are the full agreement between you and Hoalani Group about your use of the Site.

18. SMS and Text Message Communications

This section explains how Hoalani Group sends text messages (SMS and MMS) and how you can opt in, opt out, or get help. By giving us your mobile number through a Site form, an event sign up, or a client onboarding process, and by checking the box that asks for your consent, you agree to the terms below.

18.1 Program Description

We may send text messages for the following reasons:

  • Event reminders, such as webinars, training, and in person events.
  • Project and support updates for active client engagements.
  • Replies to questions you send us by text or through our Site.
  • Marketing messages about new services, blog posts, and special offers, only if you opted in to marketing texts.

18.2 How to Opt In

You can opt in by checking the SMS consent box on a Hoalani Site form, replying "YES" or "START" to a confirmation text from us, or signing a client agreement that includes SMS contact. We will not send you marketing texts unless you give clear consent. Consent to receive texts is never a condition of buying our services.

18.3 How to Opt Out

You can opt out of texts from us at any time. Reply "STOP," "END," "CANCEL," "UNSUBSCRIBE," or "QUIT" to any message you get from us. We will send one final message to confirm that you are opted out. After that, we will not send you more marketing texts. We may still send service messages tied to an active project if the law allows.

18.5 Message Frequency, Cost, and Carriers

Message frequency varies based on the program and your account activity. Message and data rates may apply, set by your mobile carrier. Hoalani Group is not responsible for delayed or undelivered messages. Carriers are not liable for delayed or undelivered messages.

Supported carriers include major mobile carriers in the United States, Canada, the United Kingdom, Spain, Portugal, Germany, Denmark, and Ghana. Service may not be available on all carriers at all times.

18.6 Privacy of Mobile Information

We will not sell, rent, or share your mobile number or text message content with third parties for their own marketing. We may share information with trusted service providers that help us send messages, only as needed to deliver the service and only under written privacy obligations. We follow GDPR, UK GDPR, CCPA, CPRA, PIPEDA, LGPD, and other local rules that apply to mobile data.

18.7 Region Specific Notices

Residents of the United States: Our SMS practices follow the Telephone Consumer Protection Act (TCPA) and CTIA messaging guidelines.

Residents of the European Economic Area and the United Kingdom: We rely on your opt in consent under the ePrivacy rules and GDPR. You can withdraw consent at any time without it affecting any service you already received.

Residents of Canada: Our SMS practices follow Canada's Anti Spam Legislation (CASL). We will only send commercial electronic messages with your express or implied consent.

Residents of Brazil: We follow the LGPD and local consumer protection rules for mobile contact.

Residents of Spain, Portugal, Germany, Denmark, and Ghana: We follow the local data protection and electronic communications laws that apply to you.

18.8 Changes to the SMS Program

We may update or stop the SMS program at any time. If we make important changes, we will give notice on this page or by text where the law requires it.
